Terms of Service

1. Service Description

Jewelry Configurator by JMS ("the App") is a Shopify application that enables merchants to offer an interactive jewelry configuration experience on their storefront. The App can connect to supplier catalog APIs, including Stuller Inc. where the merchant has authorized credentials, to display eligible product images, specifications, and pricing.

2. Eligibility

The App is available to Shopify merchants with an active Shopify store. You must have a valid Stuller retailer account or operate as an authorized Stuller reseller to access wholesale pricing and product data.

3. Subscriptions and Billing

• Subscriptions are billed monthly through the Shopify Billing API.
• All plans include a 14-day free trial. You will not be charged during the trial period.
• You may cancel at any time. Access continues until the end of the current billing period.
• Plan features and limits (series count, analytics, branding) vary by tier. See our pricing page for details.
• We reserve the right to change pricing with 30 days' notice.

4. Acceptable Use

You agree not to:

• Use the App to misrepresent product specifications or pricing
• Attempt to access supplier API data outside the scope of the App
• Reverse-engineer, copy, or redistribute the App's code or DAS mappings
• Exceed reasonable API usage limits or engage in automated scraping
• Use the App for any unlawful purpose

5. Intellectual Property

The App, including its code, design, and DAS mapping data, is the intellectual property of JMS Dev Lab. Supplier product images, videos, and catalog data remain the property of their respective owners and are displayed under their authorized usage terms.

6. Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described therein.

7. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, accuracy of Stuller pricing data, or availability of specific product series. Stuller product availability and pricing are determined by Stuller Inc. and may change without notice.

8. Limitation of Liability

To the maximum extent permitted by law, JMS Dev Lab shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including lost profits, data loss, or business interruption. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Termination

• You may uninstall the App at any time through Shopify.
• We may suspend or terminate access if you violate these terms.
• Upon termination, your configuration data will be deleted per our retention policy.

10. Changes to Terms

We may update these terms with 30 days' notice. Continued use after changes take effect constitutes acceptance. Material changes will be communicated via the App's admin dashboard or email.

11. Governing Law

These terms are governed by the laws of the jurisdiction in which JMS Dev Lab operates. Any disputes shall be resolved through binding arbitration.
